1. Services Provided

Rosell Background Check Screening provides consumer background screening services, including:

• Credit reports from TransUnion, Equifax, and Experian
• National criminal database searches
• Eviction history searches
• Identity verification and SSN trace
• Employment screening reports
• Tenant screening reports

All reports are delivered digitally in PDF format within approximately 24 hours of order submission, subject to data availability and applicant cooperation.

2. Permissible Purposes — FCRA Compliance

Our services may only be used for permissible purposes as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. Permissible purposes include:

• Tenant screening for housing applications
• Employment screening with written applicant authorization
• Extension of credit
• Other purposes permitted by the FCRA

3. User Responsibilities

By using our services, you agree to:

• Provide accurate, truthful information in all forms and submissions
• Obtain written authorization from any applicant before ordering a report on their behalf
• Use consumer reports only for the permissible purpose declared at time of order
• Comply with all FCRA requirements, including adverse action procedures
• Protect the confidentiality of any consumer report you receive
• Not share, sell, or redistribute consumer reports to unauthorized third parties
• Notify us immediately if you suspect unauthorized access to any report

4. Adverse Action Requirements

If you are a property owner, employer, or other requesting party and you take adverse action (denial, conditional approval, etc.) based in whole or in part on information in a consumer report, you are legally required under the FCRA to:

• Provide a pre-adverse action notice to the applicant before taking action
• Include a copy of the consumer report and the FCRA Summary of Rights
• Wait a reasonable time (typically 5 business days) for the applicant to respond
• Send a final adverse action notice if you proceed with the denial

Failure to comply with adverse action requirements may expose you to civil liability under the FCRA.

5. Pricing and Payment

• Self-Screening Report: $25.00 (applicant pays directly)
• Professional Report (Owner Orders): $50.00
• Enterprise Pricing: Custom — contact us for volume rates

All prices include direct bureau access fees paid to TransUnion, Equifax, and Experian. Prices are subject to change with notice.

6. Refund Policy

Exceptions may be considered at our sole discretion in cases of:

• Duplicate charges due to a verified technical error on our part
• Failure to deliver any report within 72 hours for reasons within our control

7. Accuracy of Consumer-Provided Information

The accuracy of your background report depends entirely on the accuracy of the information you provide. If you submit incorrect information (wrong SSN, name, date of birth, or address), the report may be incomplete, inaccurate, or return results for the wrong individual.

No refunds are issued for user-provided errors. We strongly encourage you to review all information carefully before submitting. If you discover an error in the underlying bureau data, you have the right to dispute it directly with the respective credit bureau.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available." We do not guarantee that:

• Any background report will be complete, error-free, or current beyond what the bureaus provide
• A clean background report guarantees approval for housing or employment
• Our services will be uninterrupted or free from technical issues

Background check data accuracy is ultimately dependent on the data maintained by TransUnion, Equifax, Experian, and government court record databases — which are outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Rosell Services LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to:

• Decisions made based on background report results
• Errors in data maintained by third-party bureaus or databases
• Delays beyond our reasonable control

Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Intellectual Property

All content on this website — including design, text, graphics, and software — is the property of Rosell Services LLC and may not be reproduced, distributed, or used without express written permission.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the courts of Miami-Dade County, Florida, or through binding arbitration at our election.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
